New Jersey Regulatory Developments - December 19, 2011

Here are the most recent healthcare related regulatory developments as published in the New Jersey Register on December 19, 2011:

On December 19, 2011 at 43 N.J.R. 3302, the Department of Banking and Insurance published notice of its proposed amendments to its rules governing small employer health benefit standard plans.  The amendments are being proposed in order to bring the plans into compliance with the requirements of the federal Patient Protection and Affordable Care Act.

On December 19, 2011 at 43 N.J.R. 3335, the Department of Health and Senior Services published notice of its adoption of new rules governing the medical marijuana program.  The new rules implement registration requirements for qualifying patients and primary caregivers and outline the requirements for registry identification cards.  The rules also set forth reporting requirements for qualifying patients, primary caregivers and physicians and describe the review process for the acceptance of petitions for additional qualifying debilitating medical conditions that will be eligible for treatment utilizing medical marijuana.

The rules also incorporate requirements for alternative treatment centers.  These include general procedures and standards applicable to alternative treatment centers, general administrative requirements for organization and record keeping of alternative treatment centers, and application procedures.  Finally, the new rules set forth the procedures for monitoring, enforcement actions, appeal rights and exemptions from state criminal and civil penalties for the medical use of marijuana.

On December 19, 2011 at 43 N.J.R. 3365, the Department of Health and Senior Services published notice of its administrative change to the rules governing the Pharmaceutical Assistance to the Aged and Disabled program to reflect an increase to the maximum annual income limits for PAAD eligibility.
