Todd has a national practice focused on issues of employment agreements and employee departures, including the litigation of injunction and damages cases related to covenants not to compete, nonsolicitation and nondisclosure covenants, unfair competition, misappropriation of trade secrets, duty of loyalty, employee raiding, the federal Economic Espionage Act and Computer Fraud & Abuse Act, the inevitable disclosure doctrine, and varied state statutes and ancillary claims.
Todd has litigated over 100 employee defection matters in numerous state and federal courts and arbitral forums. Among the clients Todd has litigated employee defection matters for are Armacell LLC, Aventis Crop Science, BB&T, ClearChannel Communications, General Dynamics, Patterson Dental, Raymond James & Associates, RF Micro Devices, Richard Childress Racing, Robert Half International and Syngenta Biotechnology.
In addition to his litigation practice, Todd routinely drafts – and assists others in drafting – employment agreements containing restrictive covenants and works closely with clients in identifying and protecting competitively valuable assets and resources. Todd is frequently a go-to resource for Womble Carlyle’s Corporate & Securities and Intellectual Property attorneys in identifying and protecting client assets in these areas, as well.
Todd is a trusted authority on various legal issues involving employer/employee disputes and is a frequent lecturer on these topics, including recent presentations for Wake Forest University School of Law and The University of North Carolina’s Kenan-Flagler Business School.
