Gray market goods are products made or authorized by a U.S. trademark or copyright owner that bear the owner’s trademark or include a copyrighted work, but are not intended for sale in the U.S. Due to differences in manufacturing costs between the U.S. and foreign countries, an incentive exists for the cheaper foreign-made goods to be imported into the U.S., often against the wishes of the U.S. trademark or copyright owner. This program discusses the legal and business considerations for combatting and engaging in the commerce of gray market goods, including the implications of the soon-to-be-decided Supreme Court case entitled Supap Kirtsaeng v. John Wiley & Sons, Inc. (No. 11-697) (argued October 29, 2012).
