Professional Biography

Christopher “Smitty” Smith represents clients including pesticide and aerospace manufacturers, waste management companies, railway transportation companies, public utilities, theme parks and municipalities on a wide range of environmental regulatory compliance and litigation matters.  

He prosecutes and defends cost recovery and contribution claims arising out of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), California’s Hazardous Substances Account Act (HSAA), the Resource Conservation and Recovery Act (RCRA), the Oil Pollution Act (OPA), the National Environmental Policy Act (NEPA), the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) and the California Environmental Quality Act (CEQA); advises and defends clients on issues presented by California’s Safe Drinking Water and Toxic Enforcement Act (Proposition 65); counsels both public and private clients on issues raised by the Clean Water Act (CWA), including negotiating and complying with the Federal and State National Pollutant Discharge Elimination System (NPDES) permits and defending Clean Water Act citizen suits; counsels waste management companies on issues concerning regulatory compliance and environmental liabilities; and defends clients in chemical exposure cases throughout federal and state courts in California.
