Insurance is a vital asset of any business. Our Insurance Recovery and Advisory Practice Group maximizes that asset for policyholders and their captive insurance companies in several ways. 

Coverage litigation: We litigate coverage disputes arising from a variety of underlying claims, including directors and officers liability, professional liability, securities fraud, antitrust violations, data breaches and other business disputes, catastrophic injury, and both first- and third-party property damage claims. We have represented insureds in coverage litigation in courts and arbitration across the country. 

Advice and Advocacy:  We provide strategic advice to and advocate on behalf of insureds and their captives regarding coverage for underlying claims.  We analyze policies and contractual insurance requirements, investigate and assess coverage for claims, and respond to reservations of rights and denials of coverage.  We advise clients as to what they can do to preserve coverage, and what they must do.  We work to find creative approaches to securing insurance funding to resolve claims and cap our client’s exposure.  We provide advice and advocacy both for specific claims and as national coverage counsel for all legal matters relating to insurance that arise in our clients’ businesses. 

Insurance Program Review:  We work with clients to prevent coverage problems before they happen.  We have provided in-house training to corporate law departments on coverage issues that recur frequently in their business. We audit our clients’ insurance programs to determine whether they have adequate systems in place to verify that they are receiving the coverage they are entitled to under contracts with third parties, including contractors, commercial tenants and borrowers. We advise clients on policy wording, enhancements, clarifications and related issues in connection with renewals.
