Lisa K. Tichy

Lisa Tichy consults on intellectual property and antitrust matters, with a particular focus on matters in the pharmaceutical and healthcare industry. She also analyzes consumer behavior in the context of consumer fraud and product liability, as well as defamation matters. Dr. Tichy has experience with consumer surveys and the analysis of media and social media content. She conducts economic analyses to assist with all stages of the litigation process, including discovery, class certification, expert reports, depositions, trial, and arbitration.

Her work on pharmaceuticals and healthcare has included:

  • Analyzing class certification and damages issues in cases involving delayed generic entry

  • Assessing the commercial success of pharmaceuticals in patent disputes, including in U.S. Patent Trial and Appeal Board matters

  • Analyzing class certification issues, damages, and models of physician prescribing behavior in cases involving alleged off-label marketing of pharmaceuticals

  • Addressing public interest issues in a Section 337 unfair import investigation in front of the International Trade Commission

  • Modeling damages in the context of patent infringement and irreparable harm matters

Her other work has included:

  • Analyzing damages and consumer perceptions in the context of a defamation case

  • Developing a consumer survey for a matter involving a “sharing economy” service

  • Assisting firms and agencies with various stages of the merger review process

  • Working with statistical experts to design and evaluate sampling schemes in mortgage-backed securities litigation and in a consumer finance matter

  • Analyzing loss causation and damages in a matter involving residential mortgage-backed securities

  • Evaluating whether a technology start-up in the financial services industry was likely to succeed
