Lisa N. Gallate

Lisa Gallate has more than 15 years legal experience, including acting on some of Australia’s largest corporate insolvencies advising insolvency practitioners, banks, directors and creditors. She has extensive commercial litigation experience in matters such as breaches of directors' and auditors’ duties and other breaches of the Corporations Act, financial product related litigation, partnership, trade practices matters, and tortious claims, and experience in representative (class action) proceedings.

Lisa regularly appears in the Federal Court of Australia and in the Supreme Courts of New South Wales and Queensland. In addition, she has appeared in the High Court and Court of Appeal in New Zealand.

Experience

  • Acting for the applicants and group members to secure final judgment orders, orders on common legal and factual issues, and to negotiate terms of settlement for group members in Wingecarribee Shire Council & Ors v. Lehman Brothers Australia Limited (In Liq) [2012] FCA 1028 (“Wingecarribee Proceedings”), a multimillion-dollar class action against Lehman Brothers Australia Limited.

  • Acting for the applicants and group members in the Wingecarribee Proceedings on the settlement and scheme of arrangement approval applications in the Federal Court.

  • Preparing 75 detailed Proofs of Debt totalling AU$150 million in the liquidation of Lehman Brothers Australia Limited.

  • Advising client creditors on their claims in the US Chapter 11 Bankruptcy of Lehman Brothers Holdings Inc.

  • Advising Australian noteholders on the compulsory alternative dispute resolution process and claim in US Bankruptcy Court Proceedings issued by Lehman Brothers Special Financing Inc.

  • Acting for the applicant and group member shareholders in a class action against directors and auditors of a publicly listed company for alleged misrepresentations in, and audits of, the financial statements of the company.

  • Advising the replacement trustees of a AU$350 million investment fund on an application to set aside their appointment and in relation to matters arising from the management and realisation of the fund’s assets.

  • Acting for the applicants and group members in City of Swan & Ors v. McGraw Hill Companies Inc in respect of alleged misrepresentations made by ratings agency, Standard & Poor’s, by assigning high credit ratings to eight complex financial products.

  • Advising the liquidators of the HIH Group on possible claims against third parties.
