Current Developments in Plan Investment Fee/Performance ERISA Litigation

Our panel will discuss recent case law developments in ERISA class action litigation challenging plan fiduciaries’ decisions to retain investments in 401(k) and 403(b) plans. The panel will focus in particular on defense strategies that have succeeded in generating successful outcomes at the motion to dismiss stage. It also will discuss best practices for plan sponsors and fiduciaries to consider as a means to avoid, or better defend, these types of lawsuits.
