Companies must battle their way into and through the market to commercialize their ideas. Protecting those efforts with intellectual property rights provides opportunities and challenges, particularly as the U.S. Patent and Trademark Office, Congress, the Federal Circuit, and the Supreme Court become more active in patent law cases, often with less consensus. We will highlight a few recent adventures in IP law - including Sections 101 and 112 - and provide concrete and actionable tips for navigating the IP waters.
