Polsinelli's Government Investigations group discusses how the Department of Justice’s prosecutorial priorities will change under a new Biden administration. Overall, a Biden DOJ will likely lead to increased white collar crime investigations and prosecutions in comparison to the Trump administration, which was more focused on immigration issues, opioid related charges, and other offenses. We will discuss which specific industries will be more prone to enforcement than others and how best to protect your clients in this new era.

Agenda

  • One of Biden’s policy proposals during the campaign was to create the Environmental and Climate Justice Division. He also proposed policy that would hold corporate executives personally responsible for antipollution violations. If Biden follows through on these campaign promises, we will see a significant uptick in environmental related enforcement.
  • The health care fraud unit will continue to be one of the most active arms of the DOJ, especially in light of the COVID-19 pandemic.
  • COVID-19 related fraud will impact white collar prosecutions outside of the healthcare industry as well. Billions of CARES Act funds were sent across the country and the Department has already started prosecuting defendants for PPP, PPE, and other COVID-19 related fraud.
