The CFPB Under Mulvaney: What Has Really Changed?

Webinar, Hosted By Ballard Spahr LLP

Tuesday, September 11, 2018 - 6:00 AM

As CFPB Acting Director, Mick Mulvaney has initiated significant changes to the Bureau’s agenda and activities, even changing the agency’s official seal so that it now refers to the Bureau as the “Bureau of Consumer Financial Protection.” At the same time, while approaching the Bureau’s use of its authorities differently than its prior leadership, Mr. Mulvaney has not, as he has put it, “burned the place down.” In fact, the Bureau’s day-to-day operations seem to have changed much less dramatically than the public statements might lead us to believe.

In this webinar, we will share our insights on what is really going on at the Bureau under Mr. Mulvaney’s leadership and our expectations for future developments. The issues we will discuss include the following:

  • Legal limits on Mr. Mulvaney’s tenure as Acting Director pending confirmation of a new Director

  • Status of constitutionality challenges

  • Status of review process for responses to requests for information

  • Update on contested enforcement actions

  • Reorganization of Bureau offices and appointment of new personnel

  • Supervision and examinations under new leadership (including with regard to military and fair lending)

  • Enforcement under new leadership (including status of fair lending enforcement)

  • Status of regulatory initiatives (including small dollar lending rule)

  • Efforts to encourage innovation

  • Future of the complaint portal
