The COVID19 pandemic has likely triggered some indefinite changes in the workplace, and statutory protections that continue through year end and beyond. Employers are faced with multiple questions, such as:

  • who can or should maintain a remote working arrangement;

  • ways to ensure the safety of essential workers, as well as those workers who may not be essential, but who wish to return to the workplace;

  • what obligations are owed to workers with underlying conditions or those who are just reluctant to return;

  • what are the ongoing statutory entitlements for workers who cannot or who do not wish to return to work; and

  • what types of medical testing, if any, are we permitted to conduct on returning workers?
