On May 23, 2016, the U.S. Department of Labor (DOL) published the Final Rule defining the overtime standards of the Fair Labor Standards Act (FLSA). These changes are expected to provide overtime to more than four million additional employees, and could add a significant cost to employers - especially those who do not correctly analyze their current workforces. Before the new Rule becomes effective (on December 1, 2016), Illinois employers will need to review the definitions of executive, administrative, and professional under Illinois Public Act 93-067 and the current federal definitions to determine which definition is applicable for overtime purposes.
