Fashion and Apparel Industry Braces for Supreme Court Ruling

In Star Athletica LLC v. Varsity Brands Inc., the Sixth Circuit Court ruled that the design used in cheerleading uniforms can be the subject of a valid copyright. This ruling, in favor of Varsity Brands, Inc., reversed the lower court’s decision, rejecting the copyright infringement claim brought by Star Athletica, and set the stage for a decision by the U.S. Supreme Court.

On October 31, 2016, the highest court in the land will be hearing arguments on the case, the first-of-its-kind case before this court involving the scope of copyright protection for apparel. The court’s decision is sure to have an impact beyond uniforms, and may re-shape, or at a minimum clarify, the otherwise murky landscape of copyright protection for apparel designs.
