In order to prevent misuse of AIA proceedings, the Patent Trial and Appeal Board (PTAB) has imposed sanctions and proposed Amendments to the Rules of Practice for Trials before the PTAB, including the requirement of Rule 11-type certification. Attorney Gilberto E. Espinoza will discuss the conduct that has given rise to such sanctions and the implications of the Board’s proposed rules.
