Asia-based companies continue to be involved in, or impacted by, International Trade Commission (ITC) Section 337 actions in the United States. As trials have resumed—at least in a virtual format—after months of pandemic-related delays and shutdowns, trends are developing, which may impact litigation strategies in the short and long term for parties on both sides of the aisle. Please join us for a discussion by three of our experienced litigators about changes in litigation strategy and procedures that have developed over the past year and how to take advantage of these developments.

Topics to be discussed include:

  • Developing an evidentiary hearing (e.g., “Zoom” depositions and planning for the unexpected)

  • Preparing for a virtual (or in-person) evidentiary hearing (e.g., flexibility is key)

  • Recent developments (e.g., relationship with other proceedings such as Patent Trial and Appeal Board (PTAB))

The webinar will be held in a Q&A format to address key strategic issues in Section 337 actions from both complainants’ and respondents’ perspectives. We encourage participants to submit questions in advance.
