Various types of post-grant proceedings are available for challenging the validity of issued patents before the Patent Trial and Appeal Board under the American Invents Act, including inter partes review, post-grant review and covered business method proceedings. Attorneys John C. Scheller and Kenneth M. Albridge III will give an overview of the general purpose, requirements and procedures for each type of proceeding and will explore respective limitations and benefits of each proceeding, recent trends and their potential effect on pending or potential district court litigation.
