PTAB and District Court Strategies: Navigating Competing Forums

Asia-based companies have broad experience as patent owners, plaintiffs, and defendants in the United States. Two prominent forums for litigation are U.S. district courts, hearing traditional litigation cases, and the Patent Trial and Appeal Board (PTAB), a specialized forum to address the validity of a patent. Both are widely used, but often involve competing interests for both plaintiff patent owners and defendants.
