Committee on Foreign Investment in the United States (CFIUS) Publishes Its 2015 Annual Report to Congress

The Committee on Foreign Investment in the United States (CFIUS) published its 2015 Annual Report to Congress on Wednesday. 

According to the report, the number of notices filed with CFIUS decreased in 2015 by four, from 147 to 143 notices, but the percentage of notices proceeding to investigation increased from 35 percent to 46 percent, with 51 proceeding to investigation in 2014 and 66 proceeding to investigation in 2015.  Of the 143 notices filed in 2015, 29 notices were filed by China, which is an increase from 2014 when China filed 24 notices and 2013 when China filed 21 notices.  Canada, the United Kingdom and Japan had the next highest number of filings in 2015, respectively.  Thirteen of the 143 notices filed in 2015 were withdrawn and 8 of those notices were re-filed that same year.  CFIUS only rejected one notice in 2015.  The report notes that “there continues to be an upward trend between 2009 and 2015 in the number of notices filed with CFIUS,” but explains that the 2009-2015 data covering overall filings with CFIUS “is not indicative of any discernible trends.”
