Professional Biography

Attorney David Shillcutt has deep experience in the areas of behavioral health, government and commercial reimbursement, and managed care due to his work at the Centers for Medicare & Medicaid Services (CMS), the Substance Abuse and Mental Health Services Administration (SAMHSA), and the Centers for Disease Control and Prevention (CDC).

Specifically, David's work includes the following:

  • Helping clients navigate the provisions of the Mental Health Parity and Addiction Equity Act, the Affordable Care Act (ACA), the 21st Century Cures Act, and the recently passed SUPPORT for Patients and Communities Act, as well as the other federal and state laws, regulations, and guidelines relating to mental health and substance abuse services
  • Providing advice to clients on mental health and substance use disorder (SUD) service coverage
  • Advising clients on legal and regulatory matters arising under Medicare, Medicaid, and other third-party reimbursement programs
  • Counseling clients on the confidentiality and privacy of SUD patient medical records, controlled substances, and the implications of proposed changes to the ACA or other potential legislation on mental health and substance abuse treatment services and coverage

Immediately before joining Epstein Becker Green, David was a Health Insurance Specialist in the Medicaid Division of Managed Care Plans at CMS. His work at CMS focused on the Innovation Accelerator Program, including physical and mental health integration and SUDs, and he led the drafting of mental health and SUD parity regulations for Medicaid and the Children's Health Insurance Program. Previously, David was a Presidential Management Fellow at the CDC’s Center for Global Health and then served as the agency lead for regulatory affairs at SAMHSA. While attending the University of Georgia School of Law, he worked at a not-for-profit health care system in Georgia, preparing policy statements on health care reform.

Before becoming a lawyer, David taught various subjects in schools around the globe, including the Lebanese International University in Beqa’a, Lebanon; the American School in Sana’a, Yemen; Academia Holy Cross in Tumbaco, Ecuador; and Central High School in Macon, Georgia.

David has been chosen by his peers for inclusion in The Best Lawyers in America©: “Ones to Watch” (2021) in the field of Health Care Law.
