On April 23, 2024, the U.S. Department of Labor (the “DOL”) promulgated a final rule, titled the “Retirement Security Rule” (the “Final Rule”), updating the definition of an “investment advice fiduciary” under the Employee Retirement Income Security Act of 1974, as amended (“ERISA”).

In brief, it would preempt current and future state comprehensive data privacy laws, set standards for the minimization of the collection and use of data, and provide for enforcement by the Federal Trade Commission, state attorneys general, and private rights of action.
