Mandatory Postings and EEO-1 Surveys: Department of Labor, Fair Labor Standards Act, Employee Polygraph Protection Act

While you may still be in summer mode, it is important that you make sure your posters are up to date.  Many employment statutes (e.g., Title VII, ADA, ADEA, FMLA, etc.) require employers to post posters informing employees of their rights.  In July, the federal Department of Labor updated its mandatory postings regarding employee rights under the Fair Labor Standards Act and the Employee Polygraph Protection Act.  The requisite postings are linked below. 

Not only do the posters help create a work culture that is free of discrimination, but the government takes the posting requirements seriously.  In July, the EEOC increased its penalty to $525 (up from $210).

Additionally, the EEO-1 survey for 2016 is now open.  The EEO-1 is an annual survey that seeks data regarding race/ethnicity, gender and job categories.  It is required of all private employers with 100 or more employees, as well as federal contractors and first-tier subcontractors with 50 or more employees and a contract/subcontract of $50,000 or more.  The survey must be completed by September 30.
