US Directorate of Defense Trade Controls Implements New Versions of Export Licensing Forms and “Guidelines for Preparing Agreements”

At the end of March, US Directorate of Defense Trade Controls (DDTC) issued new versions of export licensing forms used with its DTrade online license application system, including the DSP-5, -6, -61, -62, -73, and -74. DTrade users now are required to use only the newly issued versions of those forms, version 9.2, which are available for download on the DDTC website. Additionally, DDTC has upgraded the IBM forms viewer to version 8.2.

DDTC has also published a new iteration of the “Guidelines for Preparing Agreements,” version 4.3, which sets forth common standards for Technical Assistance Agreements, Manufacturing License Agreements, and Warehouse and Distribution Agreements. Among numerous changes to the guidelines are an explanation of circumstances where limited defense services may be approved under a DSP-5 license, clarification of how to determine the value of hardware manufactured abroad, and the addition of an Expedited Execution process for amendments to agreements for the addition of sublicensees from a previously approved territory, or name or address changes for existing sublicensees.
