The federal government is constantly seeking collaborations with private industry to develop new and innovative technologies across a wide spectrum of industries, including notably the technology and life sciences sectors. Government funding can be an important part of a growth or development strategy, but such funding presents unique issues and challenges, including those surrounding the government's acquisition of certain rights in intellectual property and data created in the performance of funded work. In this program, panelists from Covington’s Intellectual Property, Corporate, and Government Contracts Groups will discuss strategies for protecting pre-existing intellectual property and tailoring government rights in jointly developed technology when collaborating with the federal government. 

 

Topics will include:

  • Government investment in the development of innovative technology across the defense and civilian marketplace
  • Standard provisions regarding rights in intellectual property and data under the Federal Acquisition Regulations and the Bayh-Dole Act, including potential march-in rights
