Indiana Attorney General Opinion Suggests Proposed Campaign Finance Ordinance Violates Home Rule Act

A new Indiana Attorney General opinion asserts that a proposed Fort Wayne ordinance addressing campaign donations by public contractors violates the Home Rule Act.  The proposed ordinance would have made it unlawful for a person that has a contract with the city from making a political contribution of any amount to a city officeholder or a candidate for a city office.  The Attorney General opinion concludes that this proposed ordinance would violate the Home Rule Act because it purports to regulate an area already pervasively regulated by the State, namely the conduct of elections and the contributions that can be made to candidates.
