Michael Witczak is a skilled counselor and litigator representing the interests of employers across the country. Michael works with clients to design and implement practical solutions to labor and employment issues in the workplace.

Michael has represented a wide range of businesses including major restaurant chains, production companies, manufacturers, healthcare providers and logistics companies, developing a deep understanding of the unique challenges within each industry. He has substantial experience with California’s Private Attorneys General Act (PAGA) defense matters and wage and hour class actions.

He counsels clients on a range of labor and employment matters, including employee classification, wage and hour compliance and arbitration agreement practices. Michael also assists clients in drafting employee handbooks, arbitration agreements and meal and rest break policies.

Additionally, Michael has experience guiding clients through the litigation process from the initial case assessment through the ultimate resolution of the case. He has defended companies in a variety of labor and employment claims, such as independent contractor misclassification, discrimination, retaliation, wrongful termination, breach of contract and complex wage and hour representative actions.

Michael has also helped clients avert costly class action and PAGA cases by successfully compelling arbitration and obtaining ideal settlements at mediation. Michael’s experience in a wide range of litigation matters allows him to help businesses assess risk and formulate an advantageous strategy early in the litigation process. He works with businesses to formulate an action plan that suits their individual needs.

Prior to joining the firm, Michael practiced with an AmLaw 100 firm in Los Angeles, where he concentrated on labor and employment matters, litigation, class actions and PAGA defense.
