Professional Biography

Brian Larivee joins Polsinelli after five years leading in-house intellectual property litigation for both start-up and Fortune 500 biotechnology companies. Brian brings a unique lens to representing clients, having directly advised CEOs, CLOs, global franchise leads, and boards of directors on how the law of patent litigation intersects with the business imperatives of running a biotechnology company.

As an in-house litigation leader, Brian developed and implemented litigation, licensing, and freedom-to-operate strategies for a trailblazing molecular diagnostics company, including work on gene sequencing, computational biology, and diagnostic software. On the therapeutics side, Brian developed strategies and directed counsel around the world for a Fortune 500 biotechnology company. His work covered domestic and international patent disputes related to small molecule pharmaceuticals, biologic medicines, and biosimilars.

In the US, Brian’s practice included developing and implementing litigation strategies in the US Patent and Trademark Office, District Courts, the Federal Circuit, and the United States Supreme Court. Brian’s practice also included a significant international component, including patent oppositions in the European Patent Office as well as enforcement of biopharmaceutical patents in dozens of foreign jurisdictions, stretching from Estonia to Australia. Brian’s cross-border experience brings a global perspective to patent litigation campaigns, and the opportunities and risks that multi-national companies face.

Before his in-house roles, Brian spent nearly ten years practicing IP litigation at other Boston area firms on a variety of technologies including smartphones, semiconductors, and software.
