ANOTHER ONE: Allstate Hit With Another TCPA Suit

Good afternoon and happy Monday TCPA World, you guys have already gotten a couple of posts today, but I’m here to end your day with a short blog about a case coming out of the Northern District of Illinois. My first post was actually about a new TCPA claim that was filed against Allstate, and they just got hit with another one. The case is Cromie, et al. v. Allstate Insurance Company. Let’s dive right in.

There are three named plaintiffs here, two residing in New York and the third in Texas. Plaintiff’s collectively complain about a number of calls that they received from a pre-recorded avatar between December of 2020 and August of 2021. Interestingly enough, the technology being complained of “involves humans listening into a call and attempting to press computer buttons to generate a pre-recorded response that would be consistent with what a human operator might say.” Regardless, the fact remains that plaintiffs here allege that (1) the calls involved a pre-recorded voice, and (2) Allstate lacked any prior express consent. Ding ding ding, just like that this is a scary TCPA claim.

It will be interesting to see where this one ends up and we will be sure to give all of you an update when we get one. Until then, that’s all we have for you TCPA World.
