Federal Energy Regulatory Commission (FERC) Announces Changes to its eTariff Company Registration Process and Extends the Deadline for e-Tag Reporting in Electric Quarterly Reports (EQRs)

FERC is revising the company registration process for electronic tariff filings (eTariff). Under the current system, companies register through FERC's website and receive a company specific identification number (CID) and password. The company then provides the CID and password to anyone making a filing on the company's behalf. FERC has become concerned with this method of filing since the sharing of passwords is not secure and such sharing limits a company's ability to control those persons making filings on the company's behalf. Consequently, FERC is adopting a revised method whereby companies designate multiple individuals as filing agents. Filing agents will be able to log onto FERC online and submit filings on the company's behalf. The new registration procedures are expected to take effect in the third quarter of 2013.

FERC Staff will be providing further guidance on this issue and will hold a technical conference to demonstrate the new registration system. We will send out a notice once FERC announces a date for the technical conference.

EQR News

FERC has issued an order partially granting an extension of time for the reporting of e-Tag information in Electric Quarterly Reports (EQRs). FERC had previously required EQR filers to begin reporting e-Tag data in the third quarter of 2013. Compliance with this requirement has been extended indefinitely while FERC considers the benefits and burdens associated with the reporting of e-Tag data by market participants. FERC has directed Commission Staff to prepare a status report on the e-Tag reporting requirement. The report must be issued by February 8, 2014 if no Commission action has been taken by that time.

FERC's order extending the e-Tag reporting deadline does not address any of the other issues raised on rehearing, all of which are still pending FERC action.
