9:40 - 10:00 am: Risk Allocation Provisions in AIA and Other Construction Contracts
Indemnification, insurance and limitation of liability provisions are used in many contracts to allocate risk. The new AIA forms may bring renewed focus on these issues. This presentation will address key issues for negotiating, interpreting and enforcing these important clauses in any construction contract.

Presenter: Ken Gorenberg, Partner, Barnes & Thornburg

10:00 - 10:20 am: Drones in Construction—Risk and Legal Issues
Drone use in construction is becoming more common and will only increase. As with any beneficial new technology, there are also risk and legal considerations. Can insurance coverage be found under existing forms like the CGL or is a standalone aviation liability policy needed? How should the use of drones by subcontractors be addressed? This presentation will address these issues and provide guidance on how best to structure an insurance program accordingly.

Presenter: Andy Taylor, Construction and Government Contracting Division, Willis Towers Watson

10:20 - 10:30 am: Break
10:30 - 11:10 am: Identifying and Addressing Risk, and Implementing Risk Mitigation and Claims Strategies
What are the primary drivers for subcontractor default and how can you mitigate and manage risk most effectively? In this engaging presentation, you will learn about the “red flags” to be on the lookout for on project cost reports, how to confirm if the subcontractor is meeting contractual requirements and best practices for risk management throughout the project life cycle.
