In April 2018, the California Supreme Court adopted the “ABC test” standard for determining whether workers are employees or independent contractors in Dynamex Operations v. Superior Court. On September 18, 2019 California Governor Newsom signed A.B. 5, codifying the Dynamex decision and expanding the ABC test to apply not only to wage orders, but also to the Labor code and unemployment insurance claims. A.B. 5 will dramatically change the landscape for employers in California when the law takes effect on January 1, 2020.
