Virtual Conference, Hosted By Barnes & Thornburg LLP

CORPORATE RISK MANAGERS and counsel may be surprised to learn that their company can be sued by customers and others if they fail to protect user data and comply with a 1986 federal law known as the Stored Communications Act. You can take concrete steps now to reduce your risks. Then you can tell management what you see coming so that the company can prepare for it.

The Stored Communications Act (SCA) poses litigation and compliance risks for businesses large and small. The SCA provides privacy protection for a range of electronic communications and cloud storage systems, but does so in a highly complicated way that was better suited for 1986, when it was passed, than today. In the modern world, the SCA can cast an unexpectedly wide net. Companies should understand how to apply the SCA’s antiquated language to modern business practices.

Anyone who regularly deals with personal user data or cloud storage needs to understand the range of privacy pitfalls under the SCA. We will talk about how to respond to law enforcement inquiries and civil subpoenas for user data. We will examine civil claims that may be brought in commercial or employment disputes where a hacker or departing employee has wrongfully accessed shared drives or email. And we will share our thoughts on emerging disputes over the scope of the SCA, including U.S. v. Microsoft, which is currently before the Supreme Court, as well as best practices to avoid being the target of class action claims. Stay ahead of the curve. Be ready and educate your management as to what needs to be done now.
