The recent publication of proposed changes to laws implementing the Stark and Anti-Kickback laws suggest CMS and OIG are considering significant changes to these important fraud and abuse rules. In the proposed rules, the agencies consider changes designed to promote value-based care, reduce regulatory burden arising from the technical details the rules, and make fundamental changes regarding the agency’s interpretations of the laws’ rules and compliance requirements in numerous ways. Starting October 17, the industry has 75 days to provide input on the proposed rules published in the Federal Register regarding the future enforcement of the Anti-Kickback Statute (AKS). In an effort to facilitate the transition to value-based and coordinated care, the Office of the Inspector General (OIG) proposes several changes to AKS.
