New York Legislature Passes Bill to Ban PFAS in Food Packaging

On July 23, the New York Senate and Assembly passed bills that ban the use of perfluoroalkyl and polyfluoroalkyl substances (PFAS) in food packaging. More specifically, S8817/A4739C would add a new section to New York’s Environmental Conservation Law, Section 37-0209, that prohibits the distribution, sale, or offering for sale in New York of food packaging containing PFAS substances as "intentionally added chemicals."

The bill has been sent to Governor Andrew Cuomo for his signature. If he signs it, the ban will become effective December 31, 2022.
