Rule on Jurisdictional Waters under CWA (Clean Water Act) Published

Yesterday (April 21, 2014) the rule jointly proposed by the U.S. Environmental Protection Agency and  the U.S. Army Corps of Engineers to define “waters of the United States” under the Clean Water Act (CWA), was published in the Federal Register.

The 90-day period for public comment on the proposed rule starts today.  The rule has a broad base of vocal critics, including the extraction industries as well as agriculture.  Stay tuned here for further developments in connection with this rulemaking process.
