Professional Biography

Dana Stotsky focuses on environmental compliance and regulatory matters.  Dana assists clients in understanding environmental regulatory obligations, identifying the best way to maintain or re-establish compliance with those obligations, and defending them in enforcement actions.  His practice includes all areas of administrative law, including permitting, licensing, compliance assurance, responding to regulatory inquiries and inspections, responding to notices of violation, and participating in rulemaking proceedings.

Dana has 30 years of experience with federal air, water, waste, and pesticide programs.  He provides compliance training across these areas, including what to expect during inspections and regulatory evaluations.  Dana’s extensive experience allows him to quickly and efficiently negotiate positive outcomes for his clients.

From 1987 to 2014, Dana was a Senior Enforcement Attorney for Toxics with the U.S. EPA regional office in Denver where he was the lead prosecuting attorney for TSCA (toxics), FIFRA (pesticide) and EPCRA (reporting) matters and also served as a litigation consultant to EPA offices nationwide.  He has taught trial practice, negotiations and inspector training for EPA’s national training center over 30 times.

Dana served a detail from 2011-2012 with a major Indian Tribe, during which time he lived on the Reservation and provided legal counsel and litigation advice on legacy uranium mine and milling-related damages in Indian Country.  Before his work at EPA, Dana was the law clerk to the water judge in Greeley and worked for the Colorado General Assembly for two sessions, where he focused on municipal tax matters.   Dana has taught courses as an adjunct professor in law on civil procedure, evidence, administrative and environmental law and policy.
