Nancy S. Fong

Professional Biography

Nancy S. Fong is a litigation partner in Allen Matkins' Los Angeles office.  Nancy's practice focuses on construction litigation, employment, commercial, real estate and financial services litigation.  Nancy commonly represents contractors, hotel owners, commercial landlords, developers, employers and management in a variety of breach of contract, fraud, tort, construction defect, title disputes, prevailing wage, wrongful termination and discrimination disputes.  She also represents national lenders and servicers in complex consumer finance litigation and defends Fortune 500 employers in class action and employment disputes. Nancy recently successfully provided legal counsel to a hotel owner/landlord in a groundbreaking action involving rent control and the Ellis Act. She successfully argued before the Court of Appeal that the Ellis Act cannot be waived via a settlement agreement which is not supported by direct financial contribution. (Embassy, LLC v. City of Santa Monica Rent Control Board, et al. (June 14, 2010) 185 Cal. App. 4th 771).

Nancy has chaired multiple trials and arbitrations, and has argued before both federal and state courts in trial and post-trial phases.

Nancy has served as a contributing author to Business Torts: A Fifty-State Guide in each annual edition since 2011.
