Tom J. Pagliarini

Tom counsels and advises companies on all aspects of employment-related issues. He helps employers of all sizes across a variety of industries navigate federal, state, and local regulatory compliance issues. Tom provides practical guidance on day-to-day employment matters to company owners, board members, executives, general counsel, and human resources personnel. In connection with his counseling practice, Tom negotiates and drafts employment agreements, restrictive covenants, separation agreements, handbooks, policies, and other employment documents.

Tom also frequently represents employers in litigation before state and federal courts and administrative agencies in multiple jurisdictions. Tom has litigated a wide range of employment matters, including, class action disputes, discrimination, accommodation, whistleblower and retaliation, wage and hour / prevailing wage, trade secret and restrictive covenant, dual employer, misclassification, independent contractor, governmental / regulatory investigations, and employee benefits issues.

In addition, Tom utilizes his employment knowledge to assist in various employment aspects of M&A and other corporate and transactional matters. Tom has experience in conducting both buy and sell side employment due diligence, and advising on legal, practical, and other employment issues in connection with corporate and transactional matters.  

Prior to joining Mintz, Tom was a labor and employment associate at another large law firm. Tom’s in-house experience includes working with the human resources and in-house counsel teams at FGX International, CVS Health, and Schneider Electric. Prior to entering private practice, Tom clerked for Associate Justice Gilbert V. Indeglia of the Rhode Island Supreme Court and interned with Senior Circuit Judge Bruce M. Selya of the US Court of Appeals for the First Circuit and Associate Justice Brian P. Stern of the Rhode Island Superior Court, Business Calendar.
