In light of significant flooding experienced with Hurricane Sandy, we are advising all clients currently remediating contaminated sites, or currently investigating suspected contaminated sites, to consider retention of an environmental consultant to evaluate current conditions. Creating an environmental benchmark is particularly important given (1) the availability of “off-site” contamination exemptions under applicable environmental statutes and NJDEP Technical Regulations and (2) the potential for exacerbation of current contamination, especially in situations where co-mingled plumes may exist. NJDEP has also issued an Enforcement Advisory for Emergency Waste Water Management for Industrial Users. All industrial users discharging waste water to sewage treatment plants are potentially impacted.
