City of St. Louis Minimum Wage Ordinance Struck Down by Court

The Circuit Court of the City of St. Louis has struck down and enjoined implementation and enforcement of an ordinance raising the minimum wage for employees working within the geographic boundaries of the City to $8.25 per hour. The ordinance was slated to go into effect on October 15, 2015. The minimum wage in the City of St. Louis, therefore, remains consistent with state law requirements of $7.65 per hour.

The Circuit Court, on October 14, ruled the ordinance was in conflict with Missouri’s Minimum Wage Law, R.S.Mo. 290.500 to 290.530, and R.S.Mo. 71.010. No. 1522-CC10607. The Missouri law requires municipal ordinances to be in conformity with state law on the same subject. Therefore, the court held the ordinance is void and unenforceable.
