NYS Wage Theft Prevention Action – Summer 2014 Amendments Still Pending

This summer, we wrote about a bill passed by both the New York State Assembly and Senate to amend the New York State Wage Theft Prevention Act (the WTPA).  Among other things, the amendments would eliminate the need for employers to provide annual wage notices to their existing employees, impose harsher penalties for wage law violations and impose new liability on certain groups.  The bill has not been signed by Governor Cuomo and the amendments have not become effective.

Under the current law, employers are required to issue WTPA annual notices to their employees between January 1 and February 1.  However, the amendments passed early this summer, which would do away with the annual notice requirement, remain pending.  We understand that the amendments are still under consideration by the Governor and we are continuing to closely track any developments with respect to the WTPA and the amendments passed this summer.
