Update - Comment Deadline Extended for EPA Proposal to Eliminate Startup, Shutdown, and Malfunction Air Emission Exemptions in 36 States
Thursday, April 25, 2013

EPA announced it is extending the public comment period until May 13, 2013 for the agency’s proposed rule requiring 36 states, including Indiana, Illinois, Michigan, Ohio and Minnesota, to revise the startup, shutdown, and malfunction rules in their Clean Air Act State Implementation Plans (SIPs). In the Notice of Extension of Public Comment Period published on April 8, 2013, EPA stated it received numerous comments from industry groups, industry trade associations, and state and local air permitting agencies requesting a further extension of time “because the proposal is complex and far-reaching, with unique state specific issues.”

A copy of the Notice of Extension of Public Comment Period is available online at: https://federalregister.gov/a/2013-08118.

This Barnes & Thornburg Alert updates an Alert that was issued on March 8, 2013. That particular Alert outlines the proposed startup, shutdown, and malfunction rule in detail and is available online at:http://www.btlaw.com/environmental-law-alert---epa-proposes-to-eliminate-startup-shutdown-and-malfunction-air-emission-exemptions-in-36-states-03-08-2013/.
