Clean Water Act Developments [VIDEO]

Christine Wyman will discuss EPA’s final Section 401 Water Quality Certification Rule, which aims to provide structure and limits on how States consider whether discharges from federally permitted projects will impact water quality. Daniel Pope will provide an update on litigation over the Navigable Waters Protection Rule, which has been challenged in multiple federal district courts across the country, and what arguments so far have been persuasive to the judges that have considered the legality of the rule.

Daniel Pope provides environmental permitting and regulatory assistance to industrial companies, particularly in the energy sector. He also helps in the defense of environmental enforcement actions and advises on the environmental aspects of transactional matters.

Prior to joining Bracewell, Daniel served in the Office of the Attorney General of Texas as an intern in the Civil Medicaid Fraud Division, and eventually as a law clerk in the Special Litigation Division.
