New Jersey Healthcare Regulatory Developments

Here are the most recent healthcare related regulatory developments as published in the New Jersey Register on August 15, 2011:

On August 15, 2011 at 43 N.J.R. 2110, the Department of Human Services published notice of its proposed amendment to its rules governing staff to consumer ratios in partial care programs.  The Department is proposing that the current staff to consumer ratio requirement of 1:12 be changed to 1:15.

On August 15, 2011 at 43 N.J.R. 2112, the Department of Human Services published notice of its proposal of amendment to its rules regarding payment for partial hospitalization services under Medicaid.

On August 15, 2011 at 43 N.J.R. 2144, the Department of Human Services published notice of its withdrawal of a proposal to readopt without amendment the licensure standards for community care residences.

On August 15, 2011 at 43 N.J.R. 2151, the Division of Consumer Affairs published notice of its proposal of amendments to its rules governing the controlled dangerous substance schedules.

On August 15, 2011 at 43 N.J.R. 2179, the Department of Health and Senior Services published notice of its readoption with amendments to its rules governing the Hepatitis Inoculation Fund.

On August 15, 2011 at 43 N.J.R. 2188, the State Board of Respiratory Care published notice of its adoption of amendments to its rules and the adoption of a new rule governing the delegation by a respiratory care practitioner to unlicensed persons; the approval of continuing education programs, courses, seminars and articles; the determination of credits; performance-based competency assessments; licensee certification of compliance; record keeping; and audits.  In response to some commentors from the home medical equipment industry, the Board delayed its proposed amendments to the respiratory care regulations that would have disallowed the demonstration of respiratory equipment by unlicensed persons.  The Board will reconsider the proposed amendments in light of the concerns raised by various commentors.
