PA Policeman Indicted: Pennsylvania Lieutenant Arrested for Transporting Undocumented Immigrant

According to a CBS News article published on May 25, 2023, a lieutenant in the Bethel Park Police Department has been arrested on federal charges related to an illegal scheme involving undocumented immigrants. The investigation revealed that the officer allegedly transported an individual who lacked lawful immigration status in the United States, and did so knowingly, in violation of the law. Acting United States Attorney Troy Rivetti said that from around Oct. 20, 2022, through Dec. 30, 2022, the officer “transported and attempted to transport within the United States (a person) who had illegally entered the country, knowing that the (person) was illegally in the country.” If convicted, he faces up to five years in prison, a $250,000 fine, or both. The officer, who pleaded not guilty last month, is presumed innocent until proven guilty.

The officer was charged pursuant to Section 1324 of Title 8 of the U.S. Code, commonly known as the Immigration and Nationality Act (“INA”), which outlines offenses related to the harboring, transporting, and employment of undocumented immigrants. Under this section, it is illegal to knowingly encourage, induce, assist, or harbor undocumented immigrants in the United States, whether for financial gain or other reasons. Additionally, the section addresses unlawfully transporting undocumented immigrants and engaging in conspiracy or aiding and abetting such activities. Section 1324 serves as a critical component of immigration law, aiming to deter and penalize actions that contribute to the presence of unauthorized persons in the country.
