David W. Leibovitch

Professional Biography

David W. Leibovitch focuses his practice on the prosecution of utility and design patent applications, freedom-to-operate and invalidity opinions, post-grant proceedings at the U.S. Patent and Trademark Office, and District Court patent litigation. David assists Fortune 500 companies, medium-sized enterprises, small businesses and micro-entities with a range of patent matters. He also conducts intellectual property due diligence investigations to assist with mergers and acquisitions. David is a member of the firm’s Intellectual Property + Technology Group.

David’s work includes drafting, prosecution, and counseling in mechanical, electromechanical and electrical technologies. He advises innovators in Artificial Intelligence (AI), with special emphasis on the healthcare industry. He is a member of the Association for the Advancement of Artificial Intelligence.

David assists clients in various technological areas, reflecting his background in physics, mathematics and computer science. He has advised clients on a broad spectrum of mechanical inventions, including electrical supply switching and safety devices, lighting fixtures and design, printing and image processing apparatuses, medical devices, personal hygiene products, floorboards, sports equipment, conveyor belt systems, automotive systems, heat exchangers, and food manufacturing processes including filling and packaging machines. David also has counseled clients in the areas of industrial controls and testing systems, spectrometry, confocal microscopy, solar panels and solar panel components, as well as printer and image processing control software and electronics, server management, computer-implemented diagnostics, network-implemented control systems, search engines and Internet advertising systems, and vehicle control circuits and systems.

David has assisted clients in inter partes review proceedings before the U.S. Patent and Trademark Office, District Court litigations and disputes at the International Trade Commission. He also has participated in matters at the Court of Appeals for the Federal Circuit.

David is the vice-chair of the American Bar Association (ABA)’s Design Rights Committee, and a member of the Intellectual Property Owners Association (PO) European Practice Committee. He enjoys presenting on various topics of U.S. patent law to clients and colleagues in the United States and abroad, notably with the European American Chamber of Commerce (EACC) in Paris, and the Association des Praticiens Européens des Brevets (APEB). He is a native French speaker.

David has been selected by his peers for inclusion in Best Lawyers: Ones to Watch, published by Best Lawyers®, in the area of Intellectual Property Law since 2021.
