Despite previous reports to the contrary, Department of Labor (DOL) Solicitor General Patricia Smith’s recent remarks about the timing of forthcoming agency rulemakings referenced DOL’s overtime rules, not the Fiduciary Rule. According to DOL, the agency’s goal is still to proceed as scheduled with the Fiduciary Rule, which they hope to finalize in the first half of 2016. With regard to the overtime rules, DOL has confirmed that the intent is for the rules to take effect in 2016 as well.
