Employers in the home care industry should take note of a major development as the United States Department of Labor (“DOL”) on July 2, 2025, published a notice that it may be rescinding its 2013 regulations which eliminated the ability of “third-party employer” agencies to treat certain types of caregivers as exempt from the overtime and minimum wage obligations of the Fair Labor Standards Act (“FLSA”) under the Companionship and Domestic Service Exemptions.
